Equi Terms of Use
1. About Equi and these Terms
“Equi,” “we,” “us,” and “our” refer to the Equi service and the entity operating it. “You” refers to the individual using the website or services, or the person acting for a household or business. If you use the services for another person, you confirm that you have authority to do so.
These Terms apply together with the Equi Privacy Policy and any written service description, order confirmation, protection commitment, indemnity instrument, or other terms expressly provided to you. If a specific written agreement conflicts with these Terms, the specific written agreement controls for that subject only.
2. What Equi provides
Equi helps Nigerians living abroad organize relevant information, understand their property-readiness position, review overseas financial history and property goals, assess potential financing pathways, identify practical next steps, and coordinate support relating to verified-property and purchase processes.
A consultation is a focused strategy and readiness session. It may include review of information you submit, discussion of equity and down-payment position, overseas income or credit context, property goals, potential financing routes, title or verification considerations, and next steps.
Equi does not promise that you will receive a mortgage, financing approval, a specific interest rate, a specific property, a particular purchase price, or a particular completion date unless that commitment is expressly stated in a separate written agreement signed or issued by Equi.
3. Your information and your responsibilities
You must provide information that is accurate, complete, current, and not misleading. You must promptly correct information that changes.
We may contact you using the details you provide to verify identity, clarify information, assess readiness, coordinate services, schedule or reschedule a session, and discuss your application or transaction.
You are responsible for reviewing documents, title information, financial assumptions, lender or seller requirements, and transaction documents before taking action. You must not rely on an informal statement, marketing page, or verbal estimate as a substitute for a written commitment.
You must not use the website or services for fraud, unlawful activity, harassment, impersonation, unauthorized access, submission of another person’s information without permission, or any activity that could harm Equi, another customer, a seller, a lender, a service provider, or a government authority.
4. Equi protection commitment and indemnity
For an eligible property purchase or property-related transaction expressly accepted into Equi’s protection program and documented in writing, Equi provides a protection commitment intended to protect the covered purchaser from loss caused by a bad or defective title, material government inconsistency affecting the property, or demolition or compulsory loss arising from a covered title or government defect.
Where the written protection commitment applies, Equi provides full indemnity for covered direct loss in accordance with that written commitment and its claim procedure. The applicable written commitment controls the covered property, eligibility requirements, evidence required, exclusions, claim process, timing, and any remedy that must be used before a claim is paid.
No protection commitment is created by a general statement on this website alone, and no protection applies to a property or transaction that Equi has not expressly accepted in writing.
The protection does not cover loss caused by fraud or intentional misconduct by the claimant, inaccurate or withheld information, an unauthorized change to the transaction, a purchaser’s failure to follow written instructions, personal financial losses unrelated to the covered defect, market movements, ordinary construction or maintenance issues, or events outside the scope of the written protection commitment.
Nothing in these Terms removes a protection or remedy that cannot lawfully be excluded.
5. Fees, payment, and refunds
Fees are due at the time shown at checkout. A consultation fee reserves access to the consultation service and the related preparation and scheduling process.
Unless Equi has expressly offered a different refund right in writing, fees are non-refundable once paid, including where you change your mind, fail to provide requested information, do not attend, or do not proceed with a property or financing transaction.
If Equi expressly offers a refund, credit, rescheduling right, or other remedy, that offer applies only to the specific service and conditions stated in writing. A refund, credit, or rescheduling arrangement for one service does not create a general refund right for another service.
You authorize Equi and its payment processor to charge the payment method you provide for the amount shown at checkout. You must not initiate a chargeback or payment reversal for a transaction you authorized or for a service that was provided, made available, scheduled, or performed.
If you believe a payment is incorrect, contact Equi first with the transaction details so we can investigate and resolve the issue. An improper chargeback does not cancel your payment obligation.
To the extent permitted by law, you agree to reimburse Equi for reasonable costs, fees, and expenses incurred in responding to a fraudulent or wrongful chargeback, including payment-network fees and reasonable collection costs. Equi may provide the payment processor or card network with evidence of authorization, service delivery, communications, booking records, and acceptance of these Terms.
6. Scheduling and attendance
After payment, you will be directed to schedule an available consultation time or receive scheduling instructions. A booking is not complete until the calendar confirmation is issued.
You are responsible for using a valid email address, attending at the booked time, and ensuring that your phone, internet connection, and submitted information are available. Equi may permit a reasonable reschedule where capacity allows; a reschedule does not automatically create a refund right.
7. Intellectual property and permitted use
The website, Equi name, branding, text, designs, frameworks, templates, reports, and other materials are owned by or licensed to Equi. We grant you a limited, personal, non-exclusive, non-transferable right to use materials supplied to you for your own evaluation and transaction. You may not copy, sell, publish, reverse engineer, distribute, scrape, or commercially exploit them without written permission.
8. Disclaimers and limits of liability
The services are provided for information, coordination, readiness assessment, and consultation. They are not legal advice, tax advice, formal mortgage approval, lending, brokerage, surveying, valuation, title insurance, or a substitute for independent professional advice.
To the maximum extent permitted by law, Equi is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, lost profits, loss of opportunity, loss of anticipated appreciation, delay caused by a third party, or loss arising from inaccurate information supplied by you or another party.
Except for liability that cannot legally be limited and except for an express written protection commitment, Equi’s total liability relating to a service is limited to the amount you paid for that service. Nothing in these Terms excludes liability for fraud, deliberate misconduct, or a statutory right that cannot be excluded. The express protection commitment in Section 4 is the applicable remedy for a covered property loss where its written terms apply.
9. Third parties and external events
Equi may work with or refer you to lenders, sellers, developers, lawyers, surveyors, valuers, insurers, payment providers, verification providers, or other third parties. Their services, decisions, fees, timelines, and terms are their responsibility. Equi does not guarantee the conduct, availability, approval, solvency, or performance of a third party unless expressly stated in a written agreement.
We are not responsible for delay or failure caused by events outside our reasonable control, including government action, title-office delay, regulatory change, market disruption, outages, war, civil unrest, natural disaster, illness, labor disruption, or failures of communications or third-party platforms.
10. Suspension and termination
We may suspend or terminate access where information is inaccurate, payment is reversed, a security or legal risk exists, you breach these Terms, or continued service is impractical. Sections concerning payment obligations, intellectual property, disclaimers, indemnity, liability, disputes, and any written protection commitment survive termination.
11. Changes and general terms
We may update these Terms when our services, processes, or legal requirements change. The version in effect when you use a service applies to that service, unless a separate written agreement says otherwise. If a provision is unenforceable, it will be narrowed or removed only to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without our written consent.
12. Contact and disputes
Please contact Equi through the contact details or communication channel provided on the website before escalating a payment dispute. You agree to provide a reasonable opportunity to investigate and resolve a dispute. Any mandatory consumer, payment-network, or other statutory rights remain available to you.
By submitting an application or paying for a service, you confirm that you have read and accepted these Terms and the Equi Privacy Policy.
